By accessing our website at vitzael.com, purchasing any of our products or services, or submitting your information through any of our forms or campaigns, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, please do not use our services.

2. Services Provided

Vitzael offers the following services:

• Custom website design and development

• AI and third-party API integrations (including Stripe, Twilio, and others)
• Digital templates available for purchase and download
• Consulting and strategy sessions

All services are subject to a separate project agreement or purchase confirmation that outlines specific deliverables, timelines, and pricing.

3. Purchases & Payments

All purchases made through our website are processed securely via Stripe. By completing a purchase, you agree to provide accurate and complete billing information. Prices are listed in USD and are subject to change without notice.

For custom development projects, payment terms will be outlined in a separate project agreement prior to work beginning.

4. Refund Policy

Digital Templates: Due to the digital nature of template products, all sales are final. We do not offer refunds on template purchases once the product has been delivered or made accessible. If you experience a technical issue with your purchase, please contact us and we will work to resolve it.

Custom Development Services: Refund eligibility for custom projects is determined by the terms outlined in the individual project agreement. Generally, work completed and delivered is non-refundable.

5. Intellectual Property

Upon full payment, clients receive a non-exclusive license to use the deliverables produced by Vitzael for their intended business purpose. Vitzael retains the right to display completed work in its portfolio unless otherwise agreed in writing.

Purchased templates are licensed for use in a single project. Redistribution, resale, or sublicensing of templates is strictly prohibited without prior written consent from Vitzael.

6. Client Responsibilities

Clients are responsible for:

• Providing accurate project requirements and timely feedback
• Supplying any necessary content, assets, or credentials needed for the project
• Ensuring they have rights to any materials they provide to Vitzael
• Making payments according to the agreed schedule

7. Limitation of Liability

Vitzael shall not be held liable for any indirect, incidental, special, or consequential damages arising from the use of our services or products, including but not limited to loss of revenue, data, or business opportunities.

Our total liability for any claim related to our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.

8. Confidentiality

Vitzael agrees to keep confidential any proprietary business information shared by clients during the course of a project. Similarly, clients agree not to disclose any proprietary methods, tools, or processes used by Vitzael without prior written consent.

9. Third-Party Links & Services

Our website may contain links to third-party websites or integrate with third-party tools (e.g., Calendly, Stripe, Zoom). Vitzael is not responsible for the content, privacy practices, or terms of any third-party services. Use of such services is at your own discretion and subject to their respective terms.

10. Termination

Either party may terminate a service engagement with written notice. In the event of termination, the client is responsible for payment of all work completed up to the termination date. Vitzael reserves the right to suspend or terminate access to any digital products or services for violations of these terms.

11. Governing Law

These Terms of Service are governed by the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts located in California.

12. Changes to These Terms

We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated revision date. Continued use of our services after any changes constitutes your acceptance of the new terms.
